Chemung Canal Trust Company and our financial holding company, Chemung Financial Corporation, recognize that as our Customer, you have the right to expect your nonpublic personal information to remain private and secure. We want you to know that maintaining the confidentiality of your personal information is a high priority with us. This notice describes what we do with the information we collect and how we use it to provide financial products and services to you, as well as the measures we take to safeguard that information. This notice describes the privacy policy of Chemung Financial Corporation and our Affiliates, Chemung Canal Trust Company, CCTC Funding Corp. and CFS Group, Inc. The terms "we," "our" and "us" refer to Chemung Canal Trust Company and its Affiliates and the terms "you," "your" and "Customer" refer to each person who receives a financial service from us.

Information We Collect:

We collect nonpublic personal information about you from the following sources:

• Information we receive from you on applications and other forms including our web site, such as: name, address, social security number, employment status, assets, and income;
• Information about your transactions with us, our Affiliates, and others, such as: your account balance(s), payment history, and parties to the transaction;
• Information we receive from a consumer reporting agency, such as: your credit score and credit history; and,
• Information from others regarding their relationships with you, such as: an employer or creditor that we contact in order to verify information provided by you in a loan or other application.

Information We Share With Our Affiliates:

We may share all of the information we collect on you, as described above, with other members of our corporate family, called "Affiliates," in order to offer or provide you with financial services or products that may be of interest to you. For example, we may share information about you with CFS Group, Inc., a financial service provider, in order to suggest investments, insurance or other financial services. Further, CFS Group, Inc. may share information with Chemung Canal Trust Company in order to suggest loans and deposits, or other products and services.  If you do not wish us to share nonpublic personal information about you from sources such as your application(s) on file with us, your credit report(s) or from other sources with any of our Affiliates, please let us know. Please note that your request will only apply to information obtained from your application(s), credit report(s) or outside sources and may take 6-8 weeks to take effect. This request will mean that our Affiliates will not contact you about new products or services. However, in the normal course of doing business, such as servicing your accounts with us and assisting you in completing a transaction that you initiate, we will continue to share transaction and account experience with our Affiliates, as well as other information as permitted by law.

Joint Accounts:

If you submit such a request it will be binding on all accounts you maintain with us, individually or jointly, even if the joint account holder has not submitted such a request.

Information We Share With Non-affiliates:

Marketing Our Services Through And/Or With Others - We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. We may engage in these activities in order to offer you additional services or products that may be of interest to you. For example, if you are a member of our "club" checking account, you have the option of receiving accidental life insurance and travel discounts. In order to provide that option, we share certain information with our marketing agent and the insurance company that provide those benefits. All of these companies act on our behalf, are contractually obligated to keep the information that we provide them confidential, and use the information only to provide the services we have asked them to perform.

Only As Permitted By Law - Other than for the limited purpose of marketing our own products and services to you or marketing a financial product or service to be jointly offered by us and another financial institution, we will not disclose any nonpublic personal information about you, other than as permitted by law. For example, we may disclose any of the information we collect, as described above, as may be required to complete a transaction you request, such as: advising the transfer agent of Chemung Financial Corporation that, as our shareholder, you wish to be enrolled in our dividend reinvestment plan; providing pay-off information you or your agent request when you wish to satisfy a loan with us; or, forwarding information to an insurance company if you have requested credit life or accident and health coverage as an optional feature of a loan from us. We are also permitted to share this information in circumstances involving the servicing of your loan or account, the sale of your loan or other account to another financial institution or company or if you consent or request us to, such as forwarding your loan application or file to another lender or broker. We may also disclose this information in connection with: an audit, an examination by our regulators or other lawful authority, a subpoena or other form of legal process, a fraud investigation, the recording of a mortgage or other security instrument, or the reporting to credit agencies.

Other Factors Affecting Your Privacy:

Please note that some of the nonpublic personal information which we have about you in our records may also be known to others or may even be a matter of public record (available to all). For example, if you have a mortgage loan with us, your name, address, and initial amount of your loan is a matter of public record. Although we will only share nonpublic personal information about you on the limited basis described above, we cannot guard you against the actions others may take when that information is also made available to them.

Access to nonpublic personal information about you is restricted to those employees and agents who need to know the information in order to provide products and services to you.
